When should a Maryland family contact an elder law attorney?
Earlier is usually better, particularly before a major asset transfer, a diagnosis that may affect capacity, a move to assisted living, or a nursing home admission. Early advice can preserve options. If care is already needed, prompt crisis-planning advice may still be valuable.
Is elder law the same as estate planning?
No. Estate planning addresses incapacity and the transfer of assets. Elder law also considers long-term care, Medicaid eligibility, decision-making, special needs, guardianship, and other issues connected with aging. A coordinated plan often uses both.
Does Medicare pay for long-term nursing home care?
Medicare may cover limited skilled rehabilitation when its requirements are met, but it generally does not pay for ongoing custodial nursing home care. Long-term care is often paid privately, through insurance, or through Medicaid long-term care coverage after eligibility is established.
Can planning still help after a nursing home admission?
Yes. Crisis Medicaid Planning done at time of need still offers over two dozen legal and ethical strategies to obtain benefits, protect a spouse, preserve permitted assets, or correct problems with existing documents. In general, we can protect 100% of the assets for a married couple and 40–70% of the assets for an unmarried individual (sometimes more). The available planning choices depend heavily on the facts and timing, so prompt legal advice is important.
What should we bring to an initial planning conversation?
Helpful items may include current wills and trusts, powers of attorney, advance medical directives, a general asset and income summary, long-term care insurance information, and any care-facility or Medicaid paperwork. The firm can tell you what is needed for your meeting.
